Builder hoodwinks HC with fake permit
HYDERABAD:In what appears to be a classic case of forgery , the owners of a plot and a builder have been charged by the GHMC with misleading not just the civic body , but also the district collector and Hyderabad High Court by presenting them with a fake building permit.
On Monday , GHMC commissioner B Janardhan Reddy approached the Hyderabad High Court and urged it to vacate the stay order it granted in respect of a 1,000 square yard plot at Namalagundu area of Seethaphalmandi in Secunderabad and the huge multi-storied commercial building raised on it in order to enable the corporation to take action against the owners of this plot and also their builder because they misled not just the GHMC with a fake building permit, but also the district collector and the high court as well.
The GHMC chief, in his affidavit, detailed how the owners of the plot, P Rukkamma and four others, along with their builder K Yedukondalu of Seven Hills Constructions chose to mislead the authorities. According to the commissioner's affidavit, the owners applied for a building permis sion to raise a commercial building com prising two cellars, ground plus four floors in July 2013. Without waiting for approval , they commenced construction. When a notice was slapped on them in January 2016 the alleged owners and builder said they paid `60 lakh fee to the corporation towards requisite charges as per rules and also produced a building permit purportedly issued by the civic body and receipts for the `60 lakh.
However the GHMC found that the building permit was forged . Subsequently , the application was rejected . The plot owners and builder then moved the high court, and produced the fake permit as proof given to them by GHMC. Based upon this, the high court stayed the civic body's action and permitted to go ahead with the construction.
“Apart from the forged permit, we found that the said land in question was under dispute. However, they produced a certificate issued by the district collector stating that it was not government land. However, upon verification , the letter purportedly issued by him too was found out to be a fabricated one. Subsequently , we filed a criminal complaint against the builder and got him arrested. Now, we urge the HC to vacate the stay ,“ Janardhan Reddy said on Monday . The HC is slated to hear the GHMC chief 's plea next week.
