Contest Description. The Doodle 4 Google Competition (the "Contest") is designed to encourage eligible Indian school students ("Entrant(s)") to use their creativity to create their own interpretation of the Google logo. Judges will choose the winning entries and prizes will be awarded in accordance with these Official Rules.
Sponsor. The Contest is sponsored by Google Inc. ("Google"), a Delaware corporation with principal place of business at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Binding Agreement. In order to enter the Contest, you must agree to these Official Rules ("Rules"). The Rules consist of: (i) the terms and conditions on this page; (ii) the online registration/ Entry Form available on the site www.google.co.in/doodle4google. If you are a minor, you must obtain the prior permission of your parent and/or legal guardian, who must agree to these Rules on his/her and your behalf before you can enter this Contest. Because these Rules form a legally binding agreement with respect to this Contest, please read them carefully. If you do not agree to the Rules, you are not eligible to participate in the Contest or to win any of the prizes. You agree that registration for this Contest and/or a submission of an entry in the Contest constitutes your agreement to these Rules.
Eligibility. The Contest is open to Indian resident students in Standards 1 to 10 of any school in India, who have obtained their parents' and/or legal guardians' permission to enter and whose parents and/or legal guardians consent to be bound by these Rules in their own right and on behalf of the entrant. The opening date for receipt of entries by Google from participants is 25th August, 2011 and the closing date for receipt of entries by Google is 15th September, 2011, midnight (IST). Only one doodle per Entrant is allowed. In the case of duplicate or multiple entries from the same Entrant, then the first entry to arrive at the designated submission address (as determined by the "received by" date) will be accepted as the entry into the Contest. At the time of submission of a Doodle, each Entrant must: (i) be a Indian citizen (e.g., must be able to show proof of legal permanent residence, if asked for.); (ii) be enrolled in an Indian School; (iii) have obtained his or her parents’ or legal guardians’ prior permission and have agreed to be bound by these Rules. Employees, interns, contractors, and official office-holders, as well as their immediate families, of Google, its affiliates, and any representatives or agencies of Google or other persons professionally connected with the Contest are not eligible to participate.
Contest Period. The Contest begins on 25th August, 2011 and the closing date for receipt of entries by Google is 15th September, 2011, midnight (IST).
Who Can Register. Teachers, principals and representatives from Indian Schools, in addition to parents or legal guardians of children enrolled in Indian Schools, are eligible to register and submit entries on behalf of eligible Entrants ("Authorized Registrants") as defined by these Rules.
How To Enter. The registration period on the Doodle 4 Google website www.google.co.in/doodle4google. ("Contest Website") ends on 15th September, 2011, midnight (IST). Contest Materials and instructions are posted on the Contest Website. All entries must be either posted to the official address or submitted online. If posting the doodle it must be sent to the following address – Doodle 4 Google, Google India Pvt. Ltd., C/O. Wizcraft International Entertainment Pvt. Ltd, Post Box No. 11952, Azad Nagar Post Office, Andheri (West), Mumbai - 400053
Entries sent by means other than posted to the official address or submitted online or sent by anyone other than Authorized Registrants will not be considered eligible entries. Submissions must be: (i) complete (as determined by Google); (ii) in English (unless otherwise specified); (iii) received no later then 15th September 2011, midnight (IST). Any submission not meeting the aforementioned criteria will be disqualified. Google accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, howsoever caused.
Conduct. By entering the Contest, you and your Authorized Registrant agree to comply with and be bound by the Rules, which will also be posted on the Contest Website. Failure to comply with these Rules may result in your disqualification from the Contest. You further agree to comply with and be bound by the decisions of the judges, which are final and binding in all respects and no correspondence will be entered into in relation to such decision. Google reserves the right in its sole discretion to disqualify any Entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the Contest; (2) violating the Rules; (3) violating the terms of service, conditions of use or general rules or guidelines of any Google property or service; (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or (5) failure to provide documentation verifying Indian citizenship. Any false information provided within the context of the Contest by any Entrant concerning identity, postal address, ownership of rights or non-compliance with the Rules may result in the immediate disqualification of an Entrant from the Contest.
In submitting a Google Doodle each entrant represents and warrants that he/she is the owner of the Google Doodle and the copyright in it, and that in creating and submitting the Google Doodle the entrant has not violated any law for the time-being in force, including the rights of privacy and publicity of any individual. Please note that under relevant laws of India, use of the National Flag, and other national symbols such as the Ashoka Chakra for certain purposes including as part of a corporate logo, are not permitted. Each entrant consents to its being used in the manner set out in these terms, or (where the entrant is not the owner) that he/she has obtained the consent of the owner(s) to use it in the manner set out in these terms without any further payment.
Google reserves the right, at any stage, to disqualify any entry without notice to the participant who submitted that entry, including but not limited to, if it believes in its sole and unfettered discretion that such entry violates any law or regulation for the time being in force, infringes upon any third party right or otherwise does not comply with these Rules. Google’s decision in this respect will be final and binding on the participant. Google reserves the sole discretion to disqualify any entry at any stage, including for a violation of this clause.
Judging and Selection of Winners. Entries will be judged by Google employees and a panel of independent "Guest Judges" based on the following judging criteria:
Decisions of the judges are final and binding. In the event there are not enough eligible entries, not all prizes will be awarded. If a winner is not able for whatever reason to accept his or her prize, then Google reserves the right to award the prize to another Entrant. Submissions will be divided into three (3) groups in Standards 1 to 10 divided in the following groups (i) Standard 1- 3 (ii) Standards 4-6 and (iii) Standard 7-10, each a "Standard Group").
A group of 45 Finalists (15 from each Standard Group) will be announced based on a selection by a panel consisting of independent judges, based on which Google Doodles they think are the best representations of the " India’s gift to the world" theme. The 45 Finalists will be notified directly on or before 10th October 2011.
At the National Final stage the 45 Finalists will be invited to attend an awards ceremony on a date and at a location to be determined by Google (“Awards Ceremony”). At this event, the 3 Winners (1 from each Standard Group) as determined from an online public vote via www.google.co.in/doodle4google will be announced. (Online public voting open from 9 a.m. IST 24th October 2011 to 4th November 2011 midnight IST). The final overall National Winner will also be announced at the Awards Ceremony attended by the Finalists and members of our judging panel. This winner may or may not be from the list of the 3 group winners selected through the online voting.
Prizes. Acceptance of the first prize is subject to permission from a parent or legal guardian. The National Winner will receive a Technology Starter Package and a framed reproduction of the winning Google Doodle. In addition, the National Winner's Google Doodle will be displayed on the Google India homepage (www.google.co.in) for one day on Children’s Day, 14th November, 2011.
The National Winner will receive for his or her school, technology grant of up to Two Lakh Rupees. The manner in which the technology grant is to be used by the winner's school will be agreed by Google and the winner's school, subject to a cap of INR 2,00,000/- and any unused portion cannot be redeemed.
The other three winners will receive a laptop each.
All 45 Finalists will each receive a certificate of Achievement and a goody bag of Google merchandise. In addition, the entries submitted by all the 45 Finalists will be publicly displayed in a gallery on the website www.google.co.in/doodle4google from 24th October 2011 onwards, to enable members of the public to cast an online vote for their favourite entry in each Standard Group.
In order to attend the Award Ceremony all finalists must be accompanied by a parent or guardian. For finalists traveling from interstate in India, Google will provide return economy class air travel/ first class rail transport and car/ bus transfer from airport to hotel for the finalist and one parent or guardian, plus 1 night’s hotel accommodation. For finalists traveling from within the state or territory in which the Awards Ceremony is held, Google will provide the most efficient mode of transport for the finalist and one parent or guardian (as agreed with the finalist's parent or guardian), plus 1 night’s hotel accommodation. Google will arrange and pay for dinner, breakfast and lunch for each finalist and his or her parent or guardian.
There is no cash alternative and the prizes must be taken as offered. Google reserves the right to substitute prize(s) of an equivalent value should the Contest prizes become unavailable for any reason. If any winner is not able for whatever reason to accept their prize then Google reserves the right to award the prize to the next best entry, as judged by the panel consisting of independent judges and Google employees.
Media Activity: By participating in this Contest, you agree and hereby grant Google permission to use, copy, modify, distribute, and publicly display your Contest submissions for any purpose as they see fit, such as, but not limited to, within future communications, without any compensation or attribution to you. The Google Doodles may also be used by Google and its Doodle 4 Google partners for press and media purposes. You also agree to participate in any media or promotional activity regarding the Contest. If you are a Winner, you agree that Google may use your name and likeness to administer and promote the Contest and to conduct media interviews and promotional events. Google will contact entrants in advance to seek permission if any media request interviews with the winning doodler or a doodler's class. If an entrant is selected as a winner and asked to take part in media interviews, parents of all children asked to take part in the interview will be asked to fill out a media consent form provided by Google.
Privacy Notice. By participating in this Contest, you agree that Google can collect your personal information, and that if Google cannot collect the required data, you may not be eligible to participate in the Contest. Any personal information collected during the course of the Contest by Google will only be used for administering this Contest and for other purposes as outlined in these Rules, and will be subject to the practices described in the Google Privacy Policy located at http://www.google.com/intl/en/privacy.html. Except where prohibited by law, participation in the Contest constitutes the entrant's and his or her parent's and/or legal guardian's consent to the storage, use and disclosure of the entrant's entry details as set out in these Rules and also constitutes acknowledgment by the entrant and his or her parent and/or legal guardian that Google may use overseas facilities to process, store or back up its information. However, this does not change any of Google's commitments to safeguard the entrant's privacy. Subject to parental and/or legal guardian consent, the National Winner and the finalists may be required to participate in publicity such as press interviews or other promotion on the Google services, or those of its Doodle 4 Google partners, connected with the Google Doodles after the conclusion of the Contest which Google or its partners may reasonably arrange. Entrants acknowledge that Google may partner with one or more organisations for the purposes of the Contest, and entrants' personal information and Google Doodles may be disclosed to Google's partners.
General Conditions. This Contest is governed by the laws of India, and the courts in Bangalore will have exclusive jurisdiction to try any dispute arising from this Contest. By participating in this Contest, you agree to be bound by the terms of these Rules and by Google’s decisions, which are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any prize(s) that remain unclaimed at the end of 30 days from the announcement of the final results will be awarded to the next best entry(ies), as judged by the panel consisting of independent judges and Google employees.
Google does not assume any responsibility for any products and services offered under the Contest. The products and services are provided solely by the relevant vendors, under such Rules as determined by such vendors, and Google accepts no liability whatsoever in connection with such products and services. The products and services have not been certified by Google and under no circumstances shall the inclusion of any product or service in the Contest be construed as an endorsement or recommendation of such product or service by Google.
Except for warranties and conditions implied by law which cannot be excluded, Google makes no representations or warranties, express or implied, regarding the quality or suitability of any prizes awarded under these Rules. Certain legislation may imply conditions or warranties which cannot be excluded, restricted or modified except to a limited extent. In this event, to the extent permitted by law, Google's liability is limited to, at its option: (i) the replacement of the prize or the supply of an equivalent prize; or (ii) the payment, if it does not contravene any law, of the cost of the replacement or supply.
LIMITATIONS OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED GOOGLE AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED GOOGLE AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH GOOGLE WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD GOOGLE, ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED (INCLUDING BUT NOT LIMITED TO INDIRECT OR CONSEQUENTIAL LOSS) BY PARTICIPATION IN THE CONTEST AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON OR FOR ANY PERSONAL INJURY SUFFERED DURING THE COURSE OF THE PRIZE WINNING TRAVEL, EXCEPT FOR ANY LIABILITY WHICH CANNOT BE EXCLUDED BY LAW.
Third Parties. Google is not responsible for the policies, actions, or inactions of others, including Entrant’s parents/legal guardian or representatives from Schools that might prevent the Entrant from entering, participating, and/or claiming a prize in this Contest.
Intellectual Property. By registering for the Contest and/or submitting an entry you agree explicitly that all components of your artwork and supporting statement are indeed original creations. Entrants certify that their submission is original, the submission is drawn without any help from an adult, and that they are the sole and exclusive owner and rights holder of the submitted submission (or if they are not sole and exclusive owner and rights holder of the submission, that they have obtained the necessary permission to include the submission in the Contest) and that they have the right to submit the submission in the Contest. Each entrant agrees not to participate in the Contest in any manner that might: (i) infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violate applicable law in any countries in the world.
Any intellectual property infringement, misuse or plagarism of another’s work in any form or state will result in immediate disqualification and forfeiture of eligibility to receive all awards, recognition and prizes. You also agree to allow Google to make public statements regarding any disqualifications and any grounds for disqualification. Each entrant consents to all relevant acts or omissions in relation to that person's moral rights in his or her entry which may or might otherwise constitute a breach or infringement of those moral rights and, to the extent permitted by law, waives all of his or her moral rights in the entry.
All intellectual property and industrial property rights in any entries that belonged to the Entrants will remain with the Entrants, but the submissions will otherwise become the property of Google, and will not be returned during or after the Contest.
The entrant agrees that, except where prohibited by law, and unless otherwise advised by the entrant, all entries will be entered into a database and Google reserves the right to use the entrant's entry for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid by or to the entrant.
You grant Google permission to use, copy, modify, distribute, and publicly display your Contest submission for any purpose, including display on the Google website, without any attribution or compensation to you.
Internet. Google is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Google is not responsible for theft or destruction or unauthorized access to or alterations of Contest materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Google is not responsible for inaccurate transmissions of or failure to display Contest materials on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Google reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.
Severability. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
Winner List. The names of the winners will be posted on the Contest Website within two weeks of the end of the Contest.
