The purpose of the Got the “App”titude Challenge is to empower students, faculty and alumni in colleges across India to take the lead in implementing Google Apps in their colleges.
The following Google Apps Got the “App”titude Challenge (“the Challenge”) is intended for participation in India only and shall only be construed and evaluated according to Indian law. No purchase is necessary to enter or win. Entry in this Challenge constitutes your acceptance of these terms and conditions.
1. Eligibility: You must be a legal resident of India, 18 years old or older. Google shall have the exclusive right to accept or reject the applications and the decision of Google on the eligibility shall be final.
2. How to Enter: The Google Apps Got the “App”titude Challenge (“the Challenge”) begins at 9:00 A.M. IST on Monday, August 18, 2008 and ends at Midnight on January 31, 2009 (“Entry Period”) and shall be open to entries from India.
a. Google will only accept entries from students, faculty, and alumni of Engineering and MBA colleges within India
b. LIMIT ONE ENTRY PER PERSON. The submission of an entry is solely the responsibility of the entrant. Automated entries (including but not limited to entries submitted using any bot, script, macro, or Challenge service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. All entries become the property of Google, and none will be returned.
3. Conduct: By entering the Challenge, entrants agree to comply with and be bound by these Terms and Conditions. The Terms and Conditions will be posted at www.google.co.in/apps/gottheapptitude throughout the Challenge. Failure to comply with these Terms and Conditions may result in disqualification from the Challenge. Entrants further agree to comply with and be bound by the decisions of the judges, which will be final and binding in all respects. Google reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Challenge or any website; (b) violating the Terms and Conditions; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Google property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, GOOGLE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
4. Prizes: Prizes shall be determined by Google and be intimated to the winner(s). If you are chosen as a winner, you may not transfer or assign the prize to any other person.
5. Winner Selection and Notification: The winners will be selected from among all eligible entries by a judges’ panel chosen by Google. The judges will review all entries and determine the winners in their discretion. The decision of the judges is final. The winners will be announced on or about February 15, 2009 to the winner(s) via phone, email, post or overnight courier. The winner(s) may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information (such as social security number), that may be required by Google and Administrators.
All other participants will be informed about the winner(s) via email within 14 days of judging.
6. General Conditions: This Challenge is governed by the laws of India and the courts of Bangalore shall have exclusive jurisdiction.
a. By entering, participants: (a) release and hold harmless Google and Administrators, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity, and (b) grant to Google the right to use and publish their proper name and winning entry online and in print, or any other media, in connection with the Challenge. Participants also agree that you may be contacted in the future by the press and/or a representative from Google.
b. Google may contact the participant or winner for a job interview at the discretion of the Google.
7. Limitations of Liability: Google and Administrators assume no responsibility for lost, late, misdirected, illegible, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur. Google and Administrators are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Challenge, or any technical or human error which may occur in the processing of submissions in the Challenge. Google and Administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Google and Administrators are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Google and Administrators are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Challenge. If, for any reason, the Challenge is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Google and Administrators which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Challenge, Google reserves the right at its sole discretion to cancel, terminate, modify or suspend the Challenge and select winners from among all eligible entries received prior to the cancellation.
8. Intellectual Property Rights: The product created by the contestants during the Challenge, including all software (including any modifications and documentation), inventions, documents, writings and other materials conceived, prepared, made, discovered or produced by the contestant during the Challenge hosted by the Google shall be the sole and exclusive property of the Google and shall have all copyright, patent, trade secret, trademark and any other intellectual property rights ("Intellectual Property Rights") in the products .
9. Privacy: By entering the Challenge, you agree to Google’s use of your personal information, and you agree that Google can use your name, location (city and state only), statements, photograph, voice and/or likeness, and essay for any advertising and promotional purposes without further compensation, consideration, review or consent.
